
On 14 July 2026, the Solomianskyi District Court of Kyiv closed the proceedings initiated by Alexander Varvarenko, Varamar Shipping DMCC against Konstantin Kalnyi concerning alleged damage to honour, dignity and business reputation.
The court did not examine the substance of the allegations. Instead, it concluded that the dispute had been filed before a court that did not have the appropriate jurisdiction to hear it.
According to the court’s position, a dispute of this nature should be considered by Ukraine’s Commercial Courts rather than by a court of general civil jurisdiction.
The immediate procedural outcome is therefore clear: the case filed before the Solomianskyi District Court has been closed.
The underlying commercial conflict, however, remains unresolved.
At the centre of the dispute is an outstanding brokerage commission connected with completed maritime work. The broker’s position is that the services were performed, the commission was earned and payment became due.
The commission nevertheless remains unpaid.
The matter later developed beyond a conventional payment dispute. It became a public conflict involving accusations, reputational claims and litigation.
A new claim may now be filed before the Commercial Court of Kyiv. Such a step would create a new proceeding, additional hearings and further legal costs.
But a change of jurisdiction would not alter the issue that caused the conflict.
The brokerage work was completed.
The commission was earned.
The payment was withheld.
The dispute also remains connected to the so-called “WhatsApp fine” personally communicated by Mr Varvarenko and referred to in connection with the decision not to pay the brokerage commission.
A Commercial Court may eventually consider the allegations concerning business reputation.
It may also have to examine the commercial background behind those allegations, including the payment history, the contractual relationship and the communications between the parties.
The first legal proceeding has therefore ended without any decision on the merits.
No court has yet ruled on the substance of the reputational allegations.
No court has yet resolved the underlying commission dispute.
For now, the procedural venue has changed, but the central commercial issue remains exactly where it began.
The first case is closed. The unpaid commission is not.
